Abstract

Environmental problems have become one of the most important agenda items around the world since 1950’s. The books written by many intellectuals, the international conferences and the expert reports on the issue since 1960’s were very effective in this process. The most important result of this process is the development of the idea that one of the most sufficient means of protecting the environment is to make the environment a subject of the law. In other words, it is concluded that building an environmental law in international and national contexts is so important for environmental protection and sustainability. In this context, it should also be stressed that one of the key factors of such legal perspective is the concept of ‘right to environment’. So this paper, which deals with such a key concept, ‘right to environment’, includes the debates on the concept in ecological literature, determines the place of this right in general human rights, brings out the historical development and factors of ‘right to environment’ and finally allocates the concept in Turkish law.
