Abstract
This study aims to test John Braithwaite’s reintegrative shaming theory in the social and cultural context of Türkiye. It examines the relationship between the restorative potential of family and close social ties and the exclusionary practices produced by state policies and the labor market, asking whether social control processes support or hinder offenders’ reintegration. Designed as a theoretical study, it analyzes the findings of 21 studies on offenders’ post-conviction experiences in Türkiye, together with relevant legal regulations, through categories derived from the core concepts of the theory. The analysis shows that strong family ties and a collectivist culture provide a significant restorative capacity that shields offenders from exclusion by the state and the labor market. This capacity, however, is unevenly distributed. Male offenders are often accepted through patriarchal codes without being censured, whereas female offenders face double stigma and severe exclusion. The criminal justice system, inadequate rehabilitation, criminal records and employer prejudice, in turn, push individuals away from legitimate employment and increase the risk of secondary deviance. Three theoretical propositions are derived from these findings. When communitarianism is intertwined with patriarchal codes, reintegration becomes selective. Acceptance without disapproval resembles neutralization rather than reintegrative shaming. Informal restorative capacity erodes over time when it lacks institutional support. The study underlines the need for policies that are grounded in restorative justice principles, sensitive to gender and centered on employment.
