Abstract

Within the debate on digital constitutionalism, this study reconceptualises the regulation of the digital public sphere through the republican theory of freedom as non-domination and identifies the criterion of legitimate regulation. It proceeds in two stages: it first builds a conceptual-normative framework from republican political theory, the public-sphere tradition, and platform-capitalism scholarship; it then applies this framework to Türkiye’s 2007-2026 internet regulations (Laws Nos. 5651, 7253, 7418, and 7578) and the Constitutional Court’s 2021 and 2023 decisions, using the two conditions of the triadic domination test through qualitative documentary analysis. It distinguishes three sources of arbitrary power: imperium (the state’s power), dominium (the platform’s economic power), and potentia (the crowd’s power). Potentia is two-sided: it can both strengthen participation and dominate the individual, while the platform’s profit logic amplifies its dominating face and entangles the three powers. On the resulting criterion, a regulation is legitimate insofar as it reduces one source without arbitrarily expanding another. In Türkiye, the 2026 law’s child-protection provisions reduce crowd- and platform-based domination (potentia and dominium) and thus fall under Case 1 (legitimate), whereas Law No. 5651’s uncontrolled access-blocking procedure expands imperium and falls under Case 2 (illegitimate), which the Constitutional Court’s review returns to Case 1. The central implication is that regulation should rest not on content removal but on market regulation of the platform’s business model, coupled with proportionality and judicial review, and that it must not arbitrarily expand imperium.
