Abstract
Social media profiles are virtual environments in which internet users communicate with one another online, share content with their followers, and express their personal opinions regarding such content. At times, this content may consist merely of photographs reflecting an individual’s physical appearance and enabling them to be distinguished from others; at other times, it may include images revealing the person’s location, the individuals they are with, details about their private life, or their political views. Internet users may share such content with the public at their own discretion, or they may create private accounts, limiting access by selecting specific individuals with whom they wish to share their content. Today, certain websites and mobile applications claim to enable the viewing of private social media accounts. These applications constitute an issue that must be examined within the scope of criminal law, as they not only infringe upon the personality rights of both the users who download the application and the individuals whose social media profiles are viewed without consent or beyond the scope of their consent, but also violate the protection of personal data. In this study, first, the concept of a social media profile will be defined, and the distinction between public and private accounts will be addressed. Subsequently, the legal status of the data shared on social media accounts will be examined, and evaluations will be made regarding the offences committed against private account holders whose personal data are shared without consent through applications, as well as against the users of such applications.
