Abstract
This study comprehensively examines the legal status, residence permits, work rights, and social integration processes of international students pursuing higher education in Türkiye. Türkiye’s geopolitical location and the increasing international student migration due to globalization have necessitated an in-depth examination of the issue from both legal and sociological perspectives. The main research question of the study is to assess the adequacy of the student residence permit and work rights system, shaped within the framework of the Law No. 6458 on Foreigners and International Protection, in meeting current expectations, and in what ways the system can be improved in the context of its global competitiveness. The study first examines the general framework of student residence permits, exemption cases, application processes, and their interoperability with other types of residence permits from a doctrinal perspective. Furthermore, the limited work rights of students and their practical implications are evaluated. In the comparative law section, which constitutes one of the research’s focal points, the student admission systems, residence permits, visa-status distinctions, and especially post-graduation employment rights of the United States, France, and Germany are examined. The analyses conducted examine Türkiye’s practical success in regulating the education process through legislation. Furthermore, the integration of international graduates from the Turkish education system into the local labor market as strategic human capital is discussed, particularly in comparison with the United States, France, and Germany. The final section of the study addresses the socio-cultural adaptation process, which is a reflection of legal status in real life. Sociological findings examine how cultural differences such as language, religion, and ethnicity shape students’ life experiences in Türkiye, their sense of belonging, and their perception of legal security. In conclusion, it has been emphasized that, in order for the brain drain of qualified foreign talent in Türkiye to be transformed into a lasting economic and social value, clearer regulations in legislation, making administrative processes predictable, and implementing a holistic integration policy that will facilitate the employment of graduates are essential in terms of the principle of legal certainty.
