Abstract

Non-material defects in housing sales are considered as negative situations that may affect the buyer's decision to purchase. These situations are analyzed under the title of “psychological stigma” in the literature. A property's history of homicides, suicides, health-related incidents such as HIV/AIDS, sexual offenders residing in the property, or allegations of paranormal phenomena may negatively affect the buyer's perception of the property, which may lead to a decrease in the market value of the property. Such cases may be characterized as a defect for the buyer and may have a serious impact on the decision-making process. There is a rich case law and legislative accumulation on these cases, especially in the US law. In this study, the concept of psychological taint is discussed, its relationship with the concept of defect is explained, and it is evaluated whether the seller is legally obliged to disclose such cases to the buyer. In addition, the judicial decisions and legal regulations in the US states are analyzed comparatively; evaluations are made in terms of Turkish law in line with the findings obtained and various suggestions are presented.
