Abstract
In a democratic state governed by the rule of law, the freedom of the press and the prohibition of censorship are fundamental principles under constitutional guarantee. As a natural consequence of this principle, it is not possible to subject printed works to administrative or judicial review prior to publication. Indeed, under Turkish law, there is no obligation to obtain prior permission to publish periodicals; submitting a declaration to the Chief Public Prosecutor's Office is deemed sufficient. However, the seizure of printed works may arise after publication if there is suspicion that the content constitutes a crime. This study examines the measures regulated in Article 25 of the Press Law – namely, seizure as a means of proof in the first paragraph, seizure of the entire work in the second paragraph, and the ban on distribution and sales in the third paragraph – within the perspective of freedom of expression and the press. First, the normative relationship between Article 25 of the Press Law and the general seizure provisions set forth in Article 123 et seq. of the Code of Criminal Procedure is explained. Subsequently, the constitutional framework regarding the subject is established by focusing on Article 28 of the Constitution, which regulates the freedom of the press. In this context, the legal nature of the terms “zapt” and “toplatma” found in the Constitution is revealed in relation to the legal concept of seizure. In the continuation of the study, the relevant paragraphs are subjected to a detailed analysis. First, the constitutionality of the regulation granting the public prosecutor the authority to seize three copies of any printed work is discussed. Subsequently, the second paragraph, which regulates the seizure of the entire printed work to ensure confiscation, is examined. The crimes listed therein, and the legal implications of the references made to the abrogated Turkish Penal Code No. 765 are evaluated in light of the principle of legal certainty, a specific aspect of the principle of legality in crimes and punishments. Furthermore, the subject is examined in light of the current case law of the European Court of Human Rights and the Constitutional Court, and concrete suggestions for legislative amendments are offered considering the violation judgments. Finally, the study concludes by examining the ban on distribution and sales, which is limited to works printed outside of Turkey, and the condition of “strong suspicion” required for this measure.
