Abstract

This study examines the idea of peace and its paradoxical relationship with violence within a framework of philosophical critique. In historical and theoretical terms, peace treaties have often been shaped in the shadow of violence; paradoxically, the durability of peace has been made dependent on the presence and force of violence itself. Although peace emerges with the claim of putting an end to violence, it has in many cases been constructed through the very instruments and institutional forms of violence. This paradoxical structure has persisted throughout history, rendering it difficult to ground peace solely on a framework of justice. Within this study, the fragility of peace’s permanence is analyzed through Hegel’s conception of war and discussed comparatively with Kant’s project of “perpetual peace,” while the discussion is further deepened through Hannah Arendt’s argument that, in the modern age, violence produces not freedom but destruction. In this context, Benjamin’s approach, which renders visible the founding violence at the origin of law, Foucault’s analyses of the continuity of violence within modern regimes of power and security, and Derrida’s critique of the aporia of founding violence that suspends the legitimacy of law constitute the philosophical background of the peace–law–violence relationship. Furthermore, by elucidating the theoretical tension between Aron’s realism and Rawls’s liberal theory of peace, the study highlights the gap between the normative framework of democratic peace and the practical realities of international politics. Within the tradition of legal philosophy extending from Grotius to Hart, Kelsen, and Dworkin, the legal foundations of peace are examined, and the normative limitations of positive law alongside the universal principle-seeking aspirations of natural law are critically assessed. In conclusion, the study argues that peace should be conceived not merely as the absence of war or a temporary compromise, but as a teleological category that must be rethought on the basis of justice, democracy, and the rule of law, through the possibility of overcoming its paradoxical entanglement with violence.

Çalışmada Hegel’in savaş anlayışı ekseninde barışın kalıcılığına ilişkin kırılganlık, Kant’ın “ebedi barış” tasarımıyla karşılaştırmalı olarak ele alınmakta, Arendt’in modern çağda şiddetin özgürlük değil yıkım ürettiğine dair tespitleri üzerinden tartışma derinleştirilmektedir.
