Abstract

In a constitutional legal system in which human rights are violated, civil disobedience has an important position to review and change the law. For this reason, the right to necessity defense, which disobedient civil activists contribute to the constitutional process, is of great importance. On the one hand, the uncertainties about the discussions on civil disobedience, on the other hand, the radical decisions of the American legal system concerning the necessity defense used by the militants in the cases of civil disobedience (in particular indirect civil disobedience) constitute the focus of our study. In this context, we have tried to express that compulsory defense will be used for both direct and indirect actions.
