Abstract
This study evaluates the impacts of Law No. 7438 (known as EYT) on the Turkish Social Security System and its compliance with the Constitution. With the enactment of this law, the age requirement for retirement was entirely abolished for individuals whose insurance registration dates precede 08.09.1999; however, a gap of up to 17–20 years in eligibility for retirement has emerged for those insured after this date. The study argues that the regulation in violates Articles 2, 5, 10, and 60 of the Constitution and contradicts the established jurisprudence of the Constitutional Court, which emphasizes the principle of fair, reasonable, and proportionate graduated transition. To address this deficiency, a new graduated transition model is proposed. This model, instead of an approach based solely on the insurance commencement date, is based on chronological age and the number of premium payment days, aligning with the ultimate target age 65 in Law No. 5510. It is concluded that this model is a Constitutional necessity in terms of re-establishing social justice and legal certainty.
