Abstract
According to established human rights theory and the Constitution of the Republic of Turkey, interference with the right to property is only permissible in cases of public interest. There is consensus that taxes, which are the source of all services provided by the state to those living under its sovereignty, from border security to free education, constitute an interference with the right to property in the public interest. It is not easy to reach that consensus regarding the limits of interference with the right to property through taxation. This study will examine the boundaries drawn by the ECHR and the Constitution regarding the right to property and taxation authority, followed by an examination of the criteria of "excessive burden" and "manifest disproportionality" used by the Constitutional Court when examining tax laws according to Articles 2, 13, and 35 of the Constitution. Following this, we will offer suggestions for strengthening the jurisprudence of the Turkish Constitutional Court, drawing on the jurisprudence on the prohibition of confiscatory taxes in countries such as Germany and Argentina. In our view, the criterion of proportionality will only be meaningful with respect to the right to property if an upper limit is placed on the severity of the interference with the right through taxation. Otherwise, the uncertainty that dominates legal practice on this issue will carry the danger of Article 13 of the Constitution losing its effectiveness regarding property rights.
