Abstract

In recent years in Türkiye, regulations introduced particularly in the field of criminal law-commonly referred to in public discourse as “judicial reform packages”-have generated significant debates concerning the justice system and the perception of impunity. This study examines the regulations introduced under the 10th and 11th Judicial Reform Packages from the perspective of the “perception of impunity,” with the primary aim of evaluating their role in restoring public trust in the justice system. Using qualitative research methods, specifically document analysis based on content analysis, the study evaluates changes in criminal sanctions and the execution regime. The findings indicate that penalty thresholds have been increased across a wide range of offences. In particular, intentional injury, threats, the exploitation of children by criminal organizations, and acts endangering traffic safety emerge as prominent offence categories within the scope of these reforms. Furthermore, the introduction of mandatory effective execution requirements in relation to probation and conditional release mechanisms is identified as an attempt to enhance the enforceability of sanctions and to prevent the dilution of punitive effectiveness. These reforms reflect a policy orientation aimed at increasing the visibility and deterrent effect of criminal sanctions and at reducing the perception of impunity. The study concludes that the perception of impunity cannot be reduced solely to deficiencies in legal norms. A comprehensive approach requires not only increases in penalty levels but also the strengthening of judicial independence, the enhancement of institutional accountability, and the abandonment of ad hoc and temporary legislative practices in execution law.
