Abstract

This study aims to analyze how the Court of Cassation General Assembly of Civil Chambers on Civil Law (HGK), the ultimate arbiter of ‘resistance’ disputes between its chambers and lower courts, constructs phenomena such as psychological violence and mental illness as legal realities in divorce cases and the consequences it assigns. Aiming to bridge the gap between theoretical knowledge and high-level judicial practice, the research makes an original contribution to the literature by systematically examining how these abstract and difficult-to-prove concepts are substantiated by the High Court and transformed into fault narratives. Conducted using a qualitative document analysis method, the study analyzes 10 precedent-setting HGK decisions, selected through purposive sampling, via thematic content analysis. The primary findings indicate that the High Court, in constructing fault, conceptualizes psychological violence not as isolated incidents but as a continuous “pattern of behavior” and “coercive control,” in parallel with modern psychological approaches. Furthermore, the study finds that the HGK meticulously distinguishes between mental illness as a legitimate ground for divorce and its use as a “weapon” to discredit the opposing party. However, the study also reveals how rigid procedural rules, such as res judicata (final judgement), or judicial negligence can obstruct a fault narrative based on material fact, and highlights the risk of the judicial process itself transforming into a domain of “litigation abuse.” In conclusion, the article posits that while the proficiency of Turkish divorce law in constructing psychological dynamics as a legal category is advancing, significant challenges persist concerning procedural justice and the protection of victims.
