Abstract
This study aims to analyze the application of the institution of unjust provocation, as regulated in Article 29 of the Turkish Penal Code, in the decisions of the Court of Cassation General Assembly on Criminal Matters moving beyond mere legal doctrine. The primary objective of the research is to decipher the implicit social assumptions, psychological premises, power relations, and discursive structures underlying these decisions. In this study, structured with a qualitative research design, 20 decisions selected through purposive sampling from the years 2023-2025 were examined using a combination of directed content analysis and critical discourse analysis. The research findings reveal that the condition for applying the institution of unjust provocation -the ‘existence of an unjust act’- is interpreted differently in judicial practice. The content of this interpretation is shaped by social contexts such as fidelity, competition, and privacy, as well as by the evidentiary situation. It was determined that the Court, when deciding the rate of sentence reduction, employs an implicit “metric of rage” that prescribes the maximum reduction in cases involving systematic victimization, threats to life, and severe exploitation. Furthermore, it was found that in cases of evidentiary gaps, the principle of in dubio pro reo (the defendant benefits from doubt) functions as a tool for constructing a narrative of provocation in favor of the defendant. The analyses have demonstrated that judicial decisions frequently produce a discourse of “victim-blaming” and reproduce patriarchal codes within the legal sphere, particularly in the context of “honor” and protective masculinity roles. In conclusion, it has been determined that the institution of unjust provocation is not a neutral legal technique but a critical social and ideological arena where societal perceptions of justice, honor, and gender are negotiated, contested, and reproduced.
