Abstract

Within the scope of the law of occupation, the most fundamental obligation of the occupying state, which is considered to have the authority to temporarily administer the occupied territories without having sovereignty, is to protect the interests and welfare of the local population in these territories. The manifestation of this basic obligation in terms of the settlement policy pursued by the occupying state is not to implement settlement policies that disrupt the demographic structure of the region. The Occupying Power shall not deport/transfer parts of its own civilian population into the territory it occupies. Forcible transfer/deportation of individuals living in the occupied territories to the territory of another state, is prohibited, unless the safety of civilians makes it necessary, or except in cases of imperative military necessity. The settlement policy pursued by Israel in the occupied Palestinian territories violate of humanitarian rules and play an important role in the prolonged and permanent occupation. In the first part of the study, the concept of occupation is mentioned and the status of Israel is analysed. In the second part of the study, Israel’s unlawful settlements in the Palestinian territories and the concept of annexation and the obligations of third states are included.

Çalışmada ilk olarak İsrail’in insancıl hukuktan doğan yükümlülüklerinin kaynağını teşkil etmesi bakımından işgal kavramına değinilmekte, İsrail’in statüsü incelenmektedir. Çalışmanın ikinci bölümünde ise insancıl hukuk kuralları çerçevesinde İsrail’in, Filistin topraklarında izlemiş olduğu politika sonucu ortaya çıkan hukuk dışı yerleşimlere ve bu yerleşimler sonucu gündeme gelen ilhak kavramına ve üçüncü devletlerin yükümlülüklerine yer verilmektedir.
