Abstract

Eugen Ehrlich opposed the conventional wisdom that the law peculiarly comes from the state by arguing that the law lives inside the society. For Ehrlich, the principal and most common type of law is living law. Living law consists of the inner order of communities which altogether comprise the society. But Ehrlich does not deny the existence of legislation and judgments, though he prioritizes living law. In this context, living law, legislation, and judgments coexist in Ehrlich’s theory. But legislation and judgments also come from living law in the last analysis. Ehrlich characterizes living law as the essential type of law. Correspondingly, the factor of state coercion cannot distinguish legal norms from non-legal norms. Instead, Ehrlich contends that the reaction of people in case of violation determines whether a norm is legal in character. Ehrlich maintains that judges should decide freely while putting living law at the center of his theory. But Ehrlich places living law also at the center of his thoughts concerning free law movement by arguing that judges should be guided by the dominant understanding of justice in society. Article 1 of the Turkish Civil Law appears to be inspired by Ehrlich’s views. Because it provides that judges shall pursue custom when there is a gap in the relevant statute, and if this is not possible they shall make law by themselves. In this respect, Ehrlich’s theory has a practical value.
