Abstract

Turkish citizens wishing to travel to the Schengen area still require a visa, as in the past. Since this visa essentially relies on submitting documents to the consulate proving the applicant will return home after travel, it necessitates collecting documents from numerous sources, rendering the process highly arduous. Furthermore, high demand for Schengen travel and the resulting heavy consular workload further complicate applications. Consequently, given these difficulties, it is critical that issued visas offer multiple entries and long validity periods. In this regard, the process can be mitigated by the cascade system rules regulated under Article 24/2 of the Visa Code. These rules stipulate granting visas with longer validity to applicants who demonstrate their bona fides behaviour through prior lawful visa use. In this context, Commission Implementing Decision C(2025) 4696 is significant. It introduces rules more favourable than Article 24/2 of the Visa Code for Turkish residents and aims to facilitate the granting of longer validity visas within a shorter timeframe. This study outlines the general visa application process within the Visa Code and examines Article 24/2 of the Visa Code. Subsequently, it addresses the Decision and, positing that it must have direct effect to achieve the anticipated results, discusses whether the Decision satisfies the direct effect criteria shaped by the case law of the CJEU.
