Abstract
If debtors fail to pay their public debts on time, the state uses coercive collection methods. Enforced collection and its methods are regulated in three ways in Article 54 of Law No. 6183 on the Collection of Public Receivables: 'conversion of collateral into cash or pursuit of the guarantor, seizure and petition for bankruptcy'. The most frequently used of these measures is seizure. Seizure is an effective tool for collecting public receivables, but it is also a powerful form of intervention that can have adverse effects on the debtor. For this reason, the legislator has regulated the goods that cannot be seized under Article 70 of Law No. 6183, taking into account the debtor’s situation and minimum living conditions. In this context, the legislator has listed the goods that cannot be seized not only from the debtor but also from the debtor’s family. As stated in Article 41 of the Constitution, “The family is the foundation of Turkish society.” Therefore, the minimum living rights of all family members must be safeguarded. Taking this into account, the legislator has included the concept of “family” in the provisions on non-seizable property in Article 70 of Law No. 6183. The purpose of this study is to examine the provisions aimed at protecting the family, both directly and indirectly, in relation to the goods exempt from seizure under Article 70 of Law No. 6183.
