Abstract
Once a legal status has been established under the legal system of one country it comes into legal existence. For this reason, even a status established in a foreign country based on foreign law can usually take effect to a certain extent without the courts of the forum undertaking a separate act of recognition. Furthermore, in the context of Türkiye, legal statuses established by 'legal acts' in foreign countries can principally directly be recorded in Turkish official registers, provided they are officially documented (e.g. foreign marriage certificates). However, if a dispute over the validity of a legal status established abroad arises as either a main or incidental question, the Turkish court must determine the validity of the legal status. The classic method for the court to determine the validity of a legal status established abroad by a ‘legal act’ is examining the validity of the legal status according to the law which the choice of law rules of the forum state refer to. This method makes use of the “recognitive functions” of choice of law rules. Unlike Swiss choice of law rules, which, according to their constitutive and recognitive functions, can be separate rules, Turkish choice of law rules serve both functions. This means that the same connecting factors will be considered when establishing a legal status in Türkiye or recognising a legal status acquired abroad. However, although the same choice of law rule applies, a more flexible approach is taken when invoking it for its recognitive function than for its constitutive function (in matters such as public policy, incidental question, renvoi and dual nationality).
