Abstract

5510 sayılı Sosyal Sigortalar ve Genel Sağlık Sigortası Kanununun 56. maddesinin son fıkrasıyla, yaşamını yitirmiş sigortalı annesi/babası üzerinden ölüm aylığına hak kazanabilmek için evlilik bağına son verip, boşandığı eşiyle birlikte yaşamayı sürdüren kız çocuklarının veya hayatta bulunmayan sigortalı eski eşi üzerinden ölüm aylığı tahsisi için mevcut evlilik birliğini sonlandırmasına karşın sonraki eşiyle beraberliğini devam ettiren kişilerin durumu üzerinde durularak; kanuna karşı hile yoluyla evlilik birliğine resmen son verip fiilen birlikte yaşama olgusu Sosyal Güvenlik Kurumunun denetimleriyle aynı Kanunun 96. maddesi çerçevesinde fazla ve yersiz ödemelerin geri alınması sonucuna bağlanmış olup, bu konuda yaşanan hukuki uyuşmazlıklarsa Kurum ile hak sahibi olduğunu iddia eden kişi arasında icra dairelerinde takip ve de iş mahkemelerinde dava konusu yapılacaktır. Söz konusu düzenlemenin esasını da, hakkın kötüye kullanılması prensibi oluşturur.
