Özet
Fıkıh usûlü, diğer ilim dalları gibi belli bir gelişim süreci yaşamış bir disiplindir. Pek çok ilim adamının katkısıyla şekillenen bu süreç, bazı simaların bilinçli tercih ve tasarrufları ile önemli sayılabilecek kırılmaları bünyesinde barındırmaktadır. Kendi çağının gerçeklikleriyle yüzleşen ve bunu eserlerine yansıtmayı önemseyen bu âlimler, fıkıh usûlü ilmi tarihi açısından büyük bir önemi hâizdir. Bu noktada öne çıkan simalardan birisi de Sadrüşşerîa’dır (ö. 747/1346). O, Uṣûlü’l-Pezdevî adlı eseri, kendi döneminin şartları çerçevesinde yeniden gözden geçirmiş ve farklı bir telif olan Tenḳı̄ḥu’l-uṣûl ile ilim dünyasına sunmuştur. Onun bu ameliyesi, çalışmamızın ana konusunu oluşturmaktadır. Makalede Uṣûlü’l-Pezdevî ile Tenḳı̄ḥu’l-uṣûl, bir bütün olarak dikkate alınacak; bununla birlikte öne çıkan bazı misallere yer verilecektir. Bu bağlamda konu ilk önce eserlerin genel sistematiği açısından değerlendirmeye tabi tutulacak, daha sonra dil ve üslup açısından ne tür farklılaşmalar olduğu tespite çalışılacaktır. Tablonun netleşmesi için bazı farklı usûl eserleri de takip edilecektir. Bu sayede -çalışmanın temel hedefi de olan- fıkıh usûlü eserlerinin güncellenmesine dair okura bir perspektif sunulacaktır.
Abstract
Fiqh is a discipline that has shown a certain process of development, like other branches of science. This process, which is shaped by the contribution of many scholars, encapsulates the deliberate choice made, some people’s orientation towards research and the breaks that can be considered significant in the discipline. These scholars who faced with the realities of their own age and care about reflecting it in their works have a great importance in terms of fiqh history. On this point, one of the prominent figures is Sadrusharīah. He revised the work of Uṣūl al-Pazdawı̄ in the context of the conditions of his time and submitted it to the scientific world with his work titled Tanqı̄ḥ al-uṣūl as a different copyright. This copyright is the main subject of our study. In the article, Uṣūl al-Pazdawı̄ and Tanqı̄ḥ al-uṣūl will be considered as a whole; however, some prominent figures will be included. In this context, the subject will first be evaluated in terms of the general systematics of the works, and then it will be tried to determine what kinds of differentiation there are in terms of language and style. For the clarification of the situation, some another works will be handled. In this way, a perspective on the making uṣūl al-fiqh current, which is the main objective of the study, will be presented to the reader.
