Abstract

The claim that Islamic Law is a divine law is a common understanding. However, it is stated that the jurisprudence was created by divine will and human ingenuity; Considering that human and social factors such as school, politics and economics are more effective in the judgment, the claim of divinity becomes debatable. For this reason, we took and examined the claim of the divinity of Islamic Law, starting from the bio-sociological theory that sees law as a result of social life in the context of the identity of the Şârî, the difference between nassî and ijtihad judgments, the staticity, eternity, flexibility, worldliness, historicity of Islamic Law, its relationship with social reality in its birth and enforcement, the social reality in the shar’i evidences, the types of fiqh formed by social reality and the religious value of fiqh judgments. As a result, for catching the ideal, and ensuring the benefit of human and society and finding the judgment in accordance with the divine will; instead of saying that the origin of Islamic Law is only divine will, we have determined that it would be more appropriate to define it as a set of norms created in the historical process in line with the transmitted and mental data of the metaphysical and physical world.
