Abstract

The internet is a system that allows data to spread everywhere and be accessible from anywhere. In this sense, it becomes increasingly harder to protect the values that constitute the right of personality on the internet. As the rate of spread of data on the internet increases, the types and number of violations of personal rights on the internet also increase. This raises the question of which court has the international jurisdiction in case of the violation of personal right on the internet. The Court of Justice of the European Union (ECJ) has recently made two decisions on this controversial issue. This article presents and analyses the judgment of the Grand Chamber of the ECJ of 25 October 2011 in the cases of eDate and Martinez and 17 September 2017 in the cases of Bolagsupplysningen OÜ which reflecting the ECJ’s views on the application of EU jurisdictional rules (Brussels Ia Regulation) to disputes arising out of alleged violations of personality rights on the internet.

Özet

İnternet, verinin her yere yayılması ve her yerden erişilebilmesine imkân sağlayan sistemdir. İnternetin bu özel yapısı, kişilik hakkını oluşturan değerlerin internet ortamında korunmasını her geçen gün zorlaştırmaktadır. Verinin internetteki yayılım hızı arttıkça internet ortamından gerçekleşen kişilik hakkı ihlâl sayısı ve çeşitliliği de artar. Bu durum internet ortamında kişilik hakkı ihlâl edilen mağdurun hangi mahkemeye başvuracağı, başka bir deyişle kişilik hakkının internet ortamından ihlâlinde milletlerarası yetkili mahkemenin neresi olduğu sorusunu gündeme getirir. Günümüzde sıklıkla tartışılan konu hakkında Avrupa Birliği Adalet Divanı (ABAD), yakın tarihlerde iki karar vermiştir. Çalışma, internet ortamında gerçekleşen kişilik hakkı ihlâlinde milletlerarası yetkili mahkemenin tespiti noktasında ABAD’ın görüşleri ve Brüksel Ia Tüzüğü’nün uygulamasını yansıtan 25 Ekim 2011 tarihli eDate and Martinez kararı ile 17 Ekim 2017 Bolagsupplysningen OÜ kararının incelenmesine ilişkindir.
