Abstract

The employer is obliged to allow the employee to work unless there is a clear agreement to the contrary in the employment contract. Garden leave authorizes the employer not to employ the worker in the workplace. This leave is a way that the employer tries to restrict the activities of his / her worker. The employer can apply for a garden leave application for various reasons. However, garden leave is usually used in the notified termination of the employment contract. It refers to the time the worker spends in his notification period away from the workplace. As a rule, the employee is obliged to work since the business relationship continues throughout the notice period. However, the employer can save the worker from his/her duty to work by giving the worker a garden leave during this period. This leave, which is frequently applied especially in business life in England, is a concept foreign to Turkish Labor Law as it is not clearly regulated in our legislation. On the other hand, employers in our country may want to apply for this implementation for various reasons. In our study, we will explain the concept of garden leave by considering the practices in foreign law, then we will discuss the applicability of this leave in Turkish Labor Law.
