The right to education, one of the most fundamental human rights, is considered a social right which requires affirmative action of the state. As the Constitution has formulated education as a human right and the State has been imposed a series of obligations for its enjoyment, the State is obliged to take steps taking into consideration the priorities appropriate with the aims of the education service. Mere recognition and enactment of right to education is not enough for its enjoyment or fulfilment; other conditions guaranteeing it are necessary. And it is only possible when equal opportunity principle and just access to education is assured. In addition, pursuance of education service by entrepreneurs is conditioned to consent of the state. This article aims to focus on the different dimensions of education, namely education as a right, as a freedom and as a public service, and the principles related to pursuance of education service by the entrepreneurship.

En temel insan haklarından biri olarak kabul edilen eğitim hakkı, devletin olumlu katkısını zorunlu kılan sosyal bir haktır. Anayasada eğitimin bir hak olarak düzenlenmesi ve bu hakkın gerçekleştirilmesi bakımından devlete bir dizi yükümlülük yüklenmesi karşısında devlet, eğitim hizmetinin amaçlarına uygun öncelikleri gözeterek bir takım faaliyetlerde bulunmakla yükümlüdür. Eğitim hakkının tanınması ve yasalarda yer alması bu hakkın kullanımını veya gerçekleşmesini teminat altına almaya yetmemekte, hakkın kullanımını garanti edecek diğer koşulların sağlanması gerekmektedir. Bu da ancak eğitimde fırsat eşitliğini, eğitime erişimin adil olmasını sağlamakla mümkündür. Öte yandan ülkemizde eğitim hizmetlerinin özel kişilerce görülmesi devletten alınacak bir izin ile mümkündür. Bu çalışmada eğitimin hak, özgürlük ve kamu hizmeti boyutlarının ele alınması ve eğitim hizmetlerinin özel kişilerce görülme usulüne ilişkin ilkelerin incelenmesi amaçlanmaktadır.
