Abstract

At its 106th Plenary session on March 11-12, 2016, European Commission for Democracy Through Law (Venice Commission) assessed the provisions that had a problematic implementation history, such as Articles 216, 299, 301, and 314 of the Turkish Criminal Code. This study aims to translate the above-mentioned opinion and evaluate the implementation of these articles in Turkey within the aspect of the “emerging European consensus”.

Özet

Avrupa Hukuk Yolu ile Demokrasi (“Venedik”) Komisyonu, 11- 12 Mart 2016 günlerinde gerçekleşen 106. genel kurulunda, Türk Ceza Kanunu’nun 216., 299., 301., ve 314. maddeleri gibi problematik uygulama geçmişine sahip maddeleri ele almıştır. Bu çalışma, yakın Türkiye tarihinin önemli dönüm noktalarından biri olan 15 Temmuz 2016 gününden dört ay önce, belirtilen maddeler ışığında Türkiye’deki ifade özgürlüğünün Z raporunu çıkaran bu görüşün Türkçe’ye aktarılması ve bu görüşten sonra Türkiye’nin geliştirdiği uygulama ile “gelişen Avrupa konsensüsü” arasındaki mesafenin kısa yoldan değerlendirilmesinden ibarettir.
