Abstract

Nowadays, Turkey is trying to prepare her fourth Constitution in the Republican Era. The former constitutions that are 1924, 1961, 1982; had almost twenty five or thirty years-lifetime. The reason for that is, either we didn’t have any tradition of civil constitution or the articles related with economic matters were not sufficient enough i.e. The former regulations were against global economic order hence they have triggered the economic-politic crises. It seems to me, the new Constitution Amendment will have the same destiny with the formers. A constitution is either a social welfare function in the narrow sense or is an economic-politic model in the broader meaning for a society. In this economic- politic model, there are three organizations side by side; political organization (the state), economic organization (the market and it’s alternatives) and the judicial organization (the state of law). If we consider the economic regulations of a constitution; these four matters should be clarified: The name and the qualities of the economic organisation, the mechanism of resource allocation, the relationship between the economic organization and the political organization, and lastly, the economic social welfare function i.e. the social value jugdements related to equality. Yet the new constitutional sentences are prepared without this concious; the name of the economic order is not declared openly. One can understand that the new constitution prefers the market mechanism implicity because planning is not mentioned in it. Although the pro state inclination is reduced in term of civil liberties but the relationship between the state and the market is kept in tact, the result is to be a caotic economic-politic model. At the end, a constitution is a more important matter to be left only in the hands of lawyers: Because the constitution of an open society can not be written without considering the contributions of the four Nobel winner economists; namely, Hayek, Friedman, Buchanan and Arrow.
