Abstract

The regulations regarding the registration requirements for the designations of origin and the geographical indications in the European Union and Turkish law share considerable similarities. However, there are certain differences between the two legal systems in some fundamental issues such as the product types that can be registered as designation of origin and geographical indication, and the conditions for the registration of product types as designation of origin and geographical indication. The differences in legal regulations not only have a theoretical importance but also are critical in the registration process of designations of origin and geographical indications, which are registered in Turkey, in the European Union. This is because designations of origin and geographical indications registered in Turkey have to be in accordance with the requirements of the European Union acquis in order to be registered in the European Union. Following closely the legal regulations regarding the designations of origin and geographical indications in the European Union law and the current developments in the jurisdictions in the Court of Justice of the European Union and making the registration applications in the light of this information will play a critical role in speeding up the registration processes of designations of origin and geographical indications and concluding the registration applications smoothly. Within the scope of this study, firstly, conceptual differences regarding the geographical indications in European Union and Turkish law will be discussed and then registration requirements of the designations of origin and geographical indications and nonregistrable designations of origin and geographical indications will be examined in conjunction with the decisions of the Court of Justice of the European Union.
