Abstract

The transformation of property rights in contemporary planning processes has led to the redefinition of development capacity as a transferable attribute detached from land. In this context, Transfer of Development Rights emerges as a planning instrument that restructures the relationship between property rights and the public interest. The study examines the theoretical foundations of property rights and development rights, emphasizing that these rights are not absolute and can be reconfigured in line with the public interest. Different models of Transfer of Development Rights are analyzed, and their capacity to guide spatial development is evaluated. However, despite providing flexibility in planning processes, this mechanism carries the risk of deepening spatial inequalities and creating value concentration. Therefore, Transfer of Development Rights should be considered not only as a technical tool but also as part of the transformation of the property regime.
