Abstract
This article examines the legal-theoretical significance of the Prophet’s actions in al-Nāṭiq bi’l-Ḥaqq’s (d. 424/1033) al-Mujzī. Its main question is under what conditions Prophetic actions indicate a legal ruling and how that ruling applies to the Muslim community. For this purpose, the sections of al-Mujzī concerning the Prophet’s actions, the specification of general expressions by action, and the relationship between verbal statements and actions are examined together. Where necessary, al-Nāṭiq bi’l-Ḥaqq’s views are compared with those of scholars from different schools of Islamic legal theory. The study demonstrates that al-Nāṭiq bi’l-Ḥaqq does not assign all Prophetic actions to a single legal category. He distinguishes actions intended as independent legislation from those that clarify a statement, constitute compliance with a command, or are performed on the basis of rational necessity. Moreover, in the absence of contextual evidence, he does not directly assign an isolated Prophetic action to obligation, recommendation, or permissibility. Instead, he determines its legal status through indicators such as clarification, compliance with a command, continuity, praise, and blame. Another finding of the study is that a Prophetic action whose legal status has been established is considered applicable to the Muslim community unless there is evidence that it was exclusive to the Prophet. Therefore, although a Prophetic action does not in itself convey generality, it may restrict the scope of a general expression. When an apparent conflict arises between a verbal statement and an action, priority is given first to reconciliation, then to chronology, and finally to the verbal statement. In conclusion, al-Nāṭiq bi’l-Ḥaqq’s approach reflects a systematic understanding of Islamic legal theory that adopts caution in determining the legal status of Prophetic actions while maintaining shared legal applicability once their status has been established.
Özet
Bu makale, Nâtık-Bilhak’ın (ö. 424/1033) el-Müczî adlı eserinde Hz. Peygamber’in fiillerinin usûlî değerini incelemektedir. Peygamber’in fiilleri, umumun fiille tahsisi ve kavl-fiil ilişkisine dair bölümleri birlikte incelenmiş; Nâtık-Bilhak’ın görüşleri gerektiğinde farklı usûl ekollerine mensup âlimlerin görüşleriyle karşılaştırılmıştır.
