NFTs technically represent ownership information associated with a digital asset and are widely used, particularly in the fields of digital art, collectibles, and virtual assets. However, the legal nature of NFTs and their position within the existing system of intellectual and industrial property law have given rise to significant debates in both practice and legal doctrine. This study aims to examine blockchain-based NFTs from the perspective of intellectual and industrial property law. In this context, the relationship between NFTs and copyright, trademark, and design rights is analyzed, and the legal implications of NFT transfers on the moral and economic rights attached to works are evaluated. Furthermore, contemporary legal issues such as unauthorized minting and sale of NFTs, trademark infringements, and the identification of rights violations in digital environments are examined. Blockchain teknolojisinin gelişimiyle birlikte ortaya çıkan değiştirilemez tokenler (Non-Fungible Tokens – NFT’ler), dijital varlıkların mülkiyetinin ve dolaşımının yeni bir boyut kazanmasına yol açmıştır. NFT’ler, teknik olarak bir dijital varlığa ilişkin sahiplik bilgisini temsil etmekte olup, özellikle dijital sanat, koleksiyon ürünleri ve sanal varlıklar alanında yaygın biçimde kullanılmaktadır. Bununla birlikte NFT’lerin hukuki niteliği ve mevcut fikri ve sınai mülkiyet hukuku sistemi içindeki konumu, uygulamada ve doktrinde önemli tartışmalara neden olmaktadır. Bu çalışma, blockchain tabanlı NFT’leri fikri ve sınai mülkiyet hukuku perspektifinden incelemeyi amaçlamaktadır. Bu kapsamda NFT’lerin telif hakları, marka ve tasarım hakları ile olan ilişkisi ele alınmakta; NFT’nin devrinin eser üzerindeki mali ve manevi haklara etkisi değerlendirilmektedir. Ayrıca izinsiz NFT üretimi ve satışı, marka ihlalleri ve dijital ortamdaki hak ihlallerinin tespiti gibi güncel sorunlar analiz edilmektedir. Çalışmada, mevcut hukuki düzenlemelerin NFT kaynaklı uyuşmazlıkları çözmede yeterli olup olmadığı tartışılmakta ve hukuki güvenliğin sağlanmasına yönelik değerlendirme ve önerilere yer verilmektedir.
