Abstract

The European Social Charter and the Revised European Social Charter which are significant social policy documents at the international level, guarantee social and economic rights and provide for the assessment of the compliance of States Parties with the Charter. States Parties are obliged to prepare national reports on the relevant articles every year, and the European Committee on Social Rights publishes conclusions on the compliance of States Parties with the Charter. All these reports shed light on the implementation of the social and economic rights in the States Parties and show where they stand in terms of social policy. This study examines how the right to benefit from social welfare services or social services is addressed in the equally valid English and French texts of the European Social Charter, and what kind of consequences the translation differences have in terms of social services in Turkiye under this article. This is revealed through a document analysis of all relevant Council of Europe documents. In addition, a comprehensive assessment of Turkiye's compliance and non-compliance with Article 14 is made by reviewing the European Committee on Social Rights' conclusions on Turkiye and Turkiye's national reports for the last 20 years.
