Abstract

The Women's Support Application (KADES) serves as a vital tool in combating violence against women in Turkey; however, its personal data processing architecture raises significant concerns under the principles of consent, purpose limitation, and data minimisation established by the Turkish Personal Data Protection Law No. 6698 (PDPL). This qualitative study employs comparative legal document analysis to examine KADES against Spain's AlertCops application using a three-dimensional evaluation framework. The analysis identifies four structural deficiencies: the mandatory collection of national identity numbers and MERNIS verification violates the principle of data minimisation; the requirement to enter personal data before encountering the terms of use means that the prior informed consent standard is not met; no disaggregated consent options are provided for distinct data categories; and the privacy policy lacks transparency regarding retention periods and data sharing conditions. AlertCops, which requires only a phone number for registration, demonstrates that the same security function can be performed with considerably less data. Even where KADES falls within the public security exception under KVKK Article 28, the principles of data minimisation and proportionality remain binding. The study proposes architectural and policy-level reforms in line with privacy-by-design principles.

Özet

Kadın Destek Uygulaması (KADES), Türkiye'de kadına yönelik şiddetle mücadelede hayati bir araç olmakla birlikte kişisel veri işleme mimarisi, 6698 sayılı Kişisel Verilerin Korunması Kanunu'nun (KVKK) rıza, amaç sınırlılığı ve veri minimizasyonu ilkeleri bakımından sorunlar içermektedir. Bu çalışma, karşılaştırmalı hukuki doküman analizine dayanan nitel bir araştırma olup KADES'i İspanya'nın AlertCops uygulamasıyla üç boyutlu değerlendirme şeması aracılığıyla karşılaştırmaktadır. Analiz dört yapısal sorun tespit etmiştir: T.C. kimlik numarası ve MERNİS doğrulaması zorunluluğu veri minimizasyonu ilkesini ihlal etmekte; veri girişi kullanım şartlarıyla karşılaşmadan önce başladığından rıza öncesi bilgilendirme standardı karşılanmamakta; farklı veri kategorileri için ayrıştırılmış onay seçenekleri sunulmamakta; gizlilik politikası saklama süreleri ve paylaşım koşulları bakımından şeffaflıktan yoksundur. Yalnızca telefon numarasıyla kayıt yapan AlertCops, aynı güvenlik işlevinin daha az veriyle yürütülebileceğini somut biçimde göstermektedir. KADES, KVKK m. 28 kamu güvenliği istisnası kapsamında değerlendirilse dahi veri minimizasyonu ve orantılılık ilkeleri bağlayıcılığını korumaktadır. Çalışma, mahremiyet koruyucu tasarım ilkeleri doğrultusunda mimari ve politika düzeyinde değişiklikler önermektedir.
