Abstract
Throughout history, gold and silver have occupied a central position in economic life, serving as a primary measure of value and a medium of exchange in commercial transactions. These precious metals, possessing intrinsic value, maintained their status as the sole means of payment until the introduction of banknotes, which form the basis of the modern financial system and possess fiat value. However, the process of technological transformation and digitalization has brought about shifts in traditional exchange methods; transactions originally conducted through the physical commodity itself have, in certain instances, been replaced by book-entry transactions carried out via digital platforms. One of the most concrete manifestations of this transformation is the gold trading services offered by banks to their customers through mobile platforms today. These transactions conducted in a digital environment have brought along various technical and juridical (fiqh) debates in terms of Islamic Law. In particular, the nature of the transaction, the issue of qabd (taking delivery and possession) of gold— which is evaluated within the scope of sarf contract (currency exchange)—the preservation of its physical backing, and the methods by which banks procure this gold from the market remain current areas of discussion in contemporary fiqh literature. This study aims to examine the processes of gold circulation carried out through the mobile applications of banks, specifically within the context of the participation banking sector in Turkey. By subjecting the digital gold trading transactions, which have gained widespread popularity among users, to a detailed analysis, the study evaluates the position of these processes on the grounds of sharia-legitimacy. As a result of the investigation, it has been determined that in gold trading—which differs from contemporary banknotes—the stringent conditions prescribed by Islamic Law for sarf contracts and the standards set by international authorities such as AAOIFI (Accounting and Auditing Organization for Islamic Financial Institutions) encounter certain operational discrepancies in participation banking practices. Consequently, it is concluded that legal and technical regulations must be implemented urgently in this regard.
