Abstract
This study examines the balance that must be established between human rights and public security in the context of the constitutional state principle from both theoretical and legal perspectives. The obligation to provide security, which is the raison d'etre of the state, is an indispensable responsibility, especially in terms of the protection of the constitutional order, the continuity of public order and social stability. However, when this responsibility has the potential to conflict with the fundamental rights and freedoms of the individual, it brings to the agenda the limits of the constitutional state and the guarantees of the principles of the rule of law. The study argues that security should not be considered as a measure specific to exceptional cases only, but as a permanent and legitimate public purpose within the constitutional system. However, it is mandatory for the sustainability of the constitutional state principle that security policies are compatible with constitutional norms; that they are implemented in a manner that is free from arbitrariness, measured, predictable, and open to judicial review. In the research conducted with the normative analysis method, the delimitability of human rights, the principle of proportionality, the position of security in the context of the rule of law and the importance of judicial review were emphasized. As a result, it is emphasized that there is no absolute contradiction between the provision of security and the protection of rights; rather, a mutually complementary relationship should be established institutionally on the basis of constitutional principles.
