Abstract
With the advances in reproductive technologies, the method of surrogacy has become a highly controversial field in both ethical and legal terms. Although surrogacy is explicitly prohibited under Turkish law, individuals often seek to circumvent this prohibition by traveling to foreign countries where surrogacy is permitted and have children through this method abroad. When a child born through cross-border surrogacy applies to Turkish courts for a certificate of inheritance, various issues of private international law arise. In this study, the validity of the parentage relationship in the context of an inheritance certificate request involving a foreign element has been examined as a preliminary question. The approaches of lex fori and lex causae regarding the resolution of this preliminary question have also been evaluated. The research concludes that the request for a certificate of inheritance by a child born through surrogacy should not be rejected on the grounds of public policy. The judge should instead make a flexible assessment in each individual case, taking into account the best interests of the child and the principles of equity in private international law. Moreover, it has been stated that the competent court for issuing the certificate of inheritance should be determined pursuant to Article 40 of the Turkish Private International Law Act in conjunction with Article 384 of the Turkish Code of Civil Procedure.
