Abstract

Today, health services must be provided to people regardless of religion, language and race, and the security of health services must be protected. In this context, attacks against hospitals during wars or armed conflicts have become the subject of international criminal jurisdiction. The study aims to evaluate whether hospital attacks are war crimes in the context of the Palestinian Israeli War and draws attention to how health services are violated in a war environment. Within the scope of the research, qualitative research methods are used, and data is collected through the social media platform X. In the 24 hours following the hospital attack, 361 user comments reached through scans with the keyword “hospital attack” are transferred to the MAXQDA 2020 program and evaluated by thematic analysis method. The coding and theme generation process is carried out systematically based on research questions. As a result of the analysis, two main themes are identified: (1) Interpretations of the hospital attack - conceptualizations such as war crime, violation of international law, crime against humanity; (2) Reactions to the attack - condemnation, protest, diplomatic reactions and mourning. Participant comments indicate that the attacks are considered not only as a legal but also as an ethical and humanitarian crisis. As a result, it is observed that the international community should impose more effective sanctions against such attacks, that existing legal mechanisms are insufficient and that violations against health facilities have become a part of systematic war strategies. The study aims both to contribute to literature and to raise awareness on the protection of health services under wartime conditions.
