Abstract
Since the entry into force of the EU Charter of Fundamental Rights as part of the Lisbon Treaty, fundamental rights protection in the EU has been based on the EU Charter of Fundamental Rights, which constitutes positive law. However, the ECJ case law reveals that the debate on the validity of fundamental rights as a general law principle in EU law has not yet been fully concluded. Although the protection of fundamental rights has primarily been based on the EU Charter of Fundamental Rights since the entry into force of the EU Charter of Fundamental Rights in the ECJ decisions, it is seen that some ECJ decisions still rely on the subsidiary general law principle.
