Abstract
This research discusses the conflict of authority between the European Union (EU) and the International Civil Aviation Organization (ICAO) and the International Maritime Organization (IMO) that arose from the inclusion of the greenhouse gas emissions from the activities in the civil aviation and maritime transport sectors, including international voyages, into the scope of the EU’s emission trading system and the current developments. For this purpose, the legal documents in the acquis communautaire and the regulations of the ICAO and the IMO were reviewed from a historical perspective and the relevant decision of the Court of Justice of the European Union (CJEU) was mentioned. Within this framework, the research was laid out in two chapters: The first chapter discusses the inclusion of the flights from/to the aerodromes located in the EU to the EU ETS by way of amendments made in the Directive 2003/87 through the Directive 2008/101 and the complaint filed by Air Transport Association of America before the CJEU as a result of these amendments. In addition, it reviews the provisions of the Regulation 2015/757 which was adopted for the maritime transport sector and its compatibility with the provision in Article 2(2) of the Kyoto Protocol which provides that the contracting Parties work with the ICAO and the IMO to limit or reduce the emissions of greenhouse gases in the civil aviation and maritime transport sectors. The second chapter reviews the efforts made by the EU, by adopting the Directive 2023/958, the Regulation 2023/957, the Directive 2023/959, the Regulation 2023/2405 and the Regulation 2023/1805 to ensure compatibility with the ICAO and IMO regulations related to the reduction of the greenhouse gas emissions arising from the activities in the civil aviation and maritime transport sectors. As the final finding of the research, it has been found out that the EU, considering that the works carried out by the ICAO related to the reduction of greenhouse gas emissions within the framework of Article 2(2) of the Kyoto Protocol were insufficient, prompted the ICAO to make regulations in order to reduce the greenhouse gas emissions in the civil aviation sector by including the greenhouse gas emissions from the flights from/to the aerodromes located in the EU into the EU ETS and thereafter made the required amendments to the acquis communautaire in order to comply with the program CORSIA of the ICAO. In addition, it has been determined that the EU follows said strategy in the maritime transport sector and desires to prompt the IMO to adopt an international regulation on the reduction of the greenhouse gas emissions arising from the activities in the maritime transport sector, and thereafter to bring the EU ETS into compliance with this expected international regulation. However, in this regard, it is necessary to remind that the EU reserves the strategy of implementing the EU ETS in the civil aviation and maritime transport sectors again, in case the measures taken by the ICAO and the IMO are insufficient.
