Abstract
Tax revenues are the most strategic source of income for the state administration to provide public services. Therefore, audit activities by authorized officials are crucial to ensure the complete collection of tax revenues. In Turkey, tax audits are conducted using four types of audit tools. Audits other than searches are generally aimed at preventing tax evasion, while searches are a tool used when encountering tax evasion crimes. In searches related to tax evasion, a judicial crime, the activity is carried out by tax audit personnel within the scope of the Tax Procedure Law, the primary legislative source. However, there are opinions that tax-related searches are unlawful because they are judicial activities, and the audit personnel do not have the status or qualifications of judicial law enforcement officers or criminal police officers, and therefore do not fall under the Criminal Procedure Law. These opinions are sometimes challenged in courts on the same grounds. In this context, it is important to highlight the legislative gap regarding the application of judicial law enforcement in tax audits and to establish new legal regulations concerning the nature of audit personnel and tax-related search activities. This study examines the legal nature of the search (inspection) tool within the tax audit mechanism and the position of tax audit personnel in the context of their judicial law-enforcement status, using a document analysis methodology, and offers solutions to the issue.
