İBN HALDÛN'UN TESPİTLERİNE GÖRE MEMLÜK DEVLETİ YARGI SİSTEMİ

Özet

İbn Haldun Memlük Döneminde 1384-1406 yılları arasında çeşitli kereler atanmak suretiyle altı defa başkadılık görevini ihdas etmiştir. İbn Haldun başkadı olarak atanınca Memlük adlî teşkilatının büyük bir yozlaşmayla yüz yüze olduğunu görmüş ve bu kötü durumu ıslah etmek için bir takım teşebbüslerde bulunmuştur. Onun mevcut yapıyı ıslah yönündeki bu çabaları yerleşik düzeni rahatsız etmiş ve İbn Haldun çeşitli engellemelerle karşılaşmıştır. Elinizdeki bu makale İbn Haldun‘un otobiyografik eseri et-Tarif‘ten yola çıkarak, İbn Haldun‘un başkadılık yaptığı dönemi, bu dönemin özelliklerini ve İbn Haldun‘un konuyla ilgili değerlendirmelerini ele almaktadır

Abstract

Ibn Khaldun had served six times as the chief judge in the Mamluk Period between the years 1384-1406. Once appointed chief judge he saw the corruption of the Mamluk Legal Administration and attempted a number of improvement to rehabilitate the poor condition. His attempts disturbed the existing structure and Ibn Khaldun faced various obstacles. This article has examined the period of Ibn Haldun‘s chief judge, the features of this period and Ibn Khaldun‘s assessments takes place on the subject based primarily on his autobiographic book (et-Tarif)
