Özet
Bu makalede Latincede res iudicata, Fransızcada chose jugée terimleriyle ifade edilen hukuk kavramının karşılığı olarak Türkçede kullanılan “emr-i makzî”, “kaziye-i mahkûmunbiha”, “kaziye-i muhakeme”, “kaziye-i muhkeme”, kaziye-i muhkem”, “muhkem kaziye”, “kesin hüküm” gibi çeşitli terimlerin doğruluğu tartışılmaktadır. Makalede “emr-i makzî” ve “kaziye-i mahkûmunbiha” haricindeki diğer terimlerin res iudicata kavramını karşılamadığı sonucuna ulaşılmıştır
Abstract
This paper discusses the correctness of the Turkish terms “emr-i makzî”, “kaziye-i mahkûmunbiha”, “kaziye-i muhakeme”, “kaziye-i muhkeme”, kaziye-i muhkem”, “muhkem kaziye” and “kesin hüküm” in expressing the legal concept which is the terms res iudicata in Latin and chose jugée in French. The paper concludes that, except for the terms “emr-i makzî” and “kaziye-i mahkûmunbiha” all these terms are inadequate to express the concept of res iudicata
