Abstract

The obligation of suspicious transaction reporting provided for in the Law on the Prevention of Laundering of the Proceeds of Crime (Law No. 5549) requires those who are considered as obliged parties to report the transactions to MASAK, if “there is any information, suspicion or reasonable grounds to suspect that the asset, which is subject to the transactions carried out or attempted to be carried out within or through the obliged parties, has been acquired through illegal ways or used for illegal purposes”. In this context, it is important to clarify what is to be understood from the expressions of “knowledge”, “suspicion” and “reasonable grounds for suspicion”. Because, especially, the meaning of the term “knowledge” may also require a different reporting obligation than the obligation of suspicious transaction reporting for the obliged party. Indeed, if the asset subject to the transaction has been obtained from a crime or the use of the asset for illegal purposes also constitutes a crime, the obliged party who has “knowledge” about this, at the time the transaction is carried out or after the transaction is completed, may also have an obligation to report the crime. The negligence of the obligation to report the crime constitutes crime, if the conditions prescribed in the Turkish Criminal Code (Law No. 5237) are fulfilled. In this article, explanations concerning the obligation of suspicious transaction reporting in Turkish law are given and the criminal law responsibility of the person who is obliged to report in case of negligence of this obligation is examined.
