PANDEMİ ÖNCESİ VE PANDEMİ DÖNEMİNDE MUHASEBE MESLEK MENSUPLARINA VERİLEN DİSİPLİN CEZALARININ ANALİZİ: 2018-2021 DÖNEMİ

Özet

Muhasebe mesleğinde 1989 yılında yürürlüğe konulmuş olan 3568 Sayılı Kanun meslek mensuplarıile ilgili disiplin kurallarının başlangıcını oluşturmaktadır. Muhasebe meslek mensuplarınınyürürlükteki mesleki standartlar ile etik ilkeler dışına çıkan faaliyetleri varsa bunlar disiplin cezalarıkapsamına girmektedir. Serbest Muhasebeci Mali Müşavirlik ve Yeminli Mali Müşavirlik KanunuDisiplin Yönetmeliği’nin amacı meslek mensuplarına daha çok ceza vermekten ziyade, etik değerleriyüksek olan meslek mensubu sayısını artırmak ve meslek örgütüne olan güveni oluşturmaktadır. Buçalışmanın amacı, bu yönetmelik kapsamında 2018-2021 yılları arasında meslek odaları tarafındanyönetmelik kapsamında verilen disiplin cezalarını incelemektir. Meslek mensuplarına verilen disiplincezaları; cezanın türü, verildiği dönem, meslek mensubunun kayıtlı olduğu odanın bulunduğu coğrafibölgesi, tek seferde bir meslek mensubuna verilen ceza sayısı, cezanın pandemi öncesi ya da pandemidöneminde verilmiş olması ve unvanları açısından değerlendirilmiştir. Çalışmada 2018-2021 yılları arasında Türkiye Serbest Muhasebeci Mali Müşavirler ve Yeminli Mali Müşavirler Odaları Birliği(TÜRMOB) internet sayfasında ilan edilmiş disiplin cezaları kullanılmıştır. Çalışmada derlenenveriler içerik analizi ile değerlendirilmiş ve belirlenen değişkenlere ait sayısal veriler SPSS programıyardımıyla analiz edilmiştir. Pandemi dönemi olan 2020 ve 2021 yıllarında meslek mensuplarınaverilmiş olan cezalarda sayısal olarak artış olduğu görülmekle birlikte yapılan test sonucundaistatistiki olarak anlamlı bir fark tespit edilememiştir. Ayrıca meslek mensuplarına verilen cezalar ilediğer değişkenlerin (unvan, coğrafi bölge, dönem) tamamında yapılan analizler sonucunda istatistikselolarak anlamlı farklılık olmadığı tespit edilmiştir.

Abstract

Law No. 3568, which was put into effect in 1989 in the accounting profession, constitutes the beginningof the disciplinary rules regarding the members of the profession Professional accountants areobliged to comply with professional standards and ethical codes while performing their professionalactivities. Certified Public Accountant and Certified Public Accountant Law Disciplinary Regulationaims to increase the number of professionals with high ethical values and to establish the trust in theprofessional organization, rather than punishing the members of the profession more. The aim of thisstudy is to examine the disciplinary penalties given by the professional chambers within the scopeof the regulation between 2018-2021. Disciplinary penalties in the study were evaluated in terms ofthe type of punishment, period of issue, the geographical region of the chamber where the memberof the profession is registered, the number of penalties given to a member of the profession at a time,whether the penalty was given before or during the pandemic period and the title of the professional.In the study, disciplinary penalties announced on the website of the Union of Chambers of CertifiedPublic Accountants of Turkey between the years 2018-2021 were used. The collected data in the studywere evaluated by content analysis and the numerical data of the selected variables were analyzed viaa SPSS program. While there was an increase in the number of penalties received by the membersof the profession in 2020 and 2021, i.e., the pandemic period, no statistically significant differencewas observed as a result of the test. In addition, it has been determined that there is no statisticallysignificant difference as a result of the analyzes made in all of the penalties given to the members ofthe profession and other variables (title, geographical region, period).
