Abstract

Islamic Sukuk is a financing instrument arising from fiqh and is issued based on one of the contracts inIslamic law. It is considered one of the essential products of the Islamic finance industry. It plays a vital rolein developing economic activities by transferring funds from those with liquidity to those short of financialresources. Musharakah Sukuk is one of the types of Sukuk and is subject to all the terms and conditions ofthe Musharakah, known as the Musharakah contract in fiqh. It is considered one of the most importantfinancing tools of Islamic finance, as it can be used in financing mega projects challenging for countries andfinancial institutions to finance independently. This study aims to reveal the Musharakah Sukuk in all itsaspects and to examine its fiqh aspect. In order to achieve this aim, the deductive method was followed inthe study. The study concluded that the Musharakah Sukuk issuance process is an important element foreconomic activity and an effective way to attract and mobilize funds. However, it must comply with Shariahstandards. Therefore, the issuance of the Musharakah Sukuk should be allowed after the approval of theAdvisory Board.
