Zekât Mallarında Aranan Şartlar Bağlamında Sosyal Sorumluluk

Özet
Konu ve Amaç: Zekât, Kur’ân ve Sünnet’le farz kılınan, Hanefîlere göre salt ibadet, cumhura göre ise mala müteallik bir mükellefiyettir. Zekât verilecek mallar naslarda delâleten ve sarâhaten zikredilmişlerdir. Fukaha, bu malların zekâta tâbi olabilmesi için bulunması lazım olan şartları “mülkiyet, nemâ, havâic-i asliyye, nisab, borç ve yıl” olarak belirlemişlerdir. Bu şartların bazıları sosyal sorumluluğu dolaylı olarak ilgilendirirken bazıları da doğrudan ilişkilidir. Bu ilişki iki taraflıdır: Birincisi üretimi yani tasarrufu teşvik ve zekât mükellefinin geçimine yöneliktir. İkincisi ise infaka muhatap olması bakımından zekâtın sarf yerlerini yani toplumun harcama eğilimi en yüksek katmanını ilgilendirmektedir. Mülkiyet, malla maliki arasındaki bağı ve mal üzerindeki tasarruf hakkını ifade etmektedir. Diğer şartlar ise malikin üzerinde tasarruf hakkına sahip olduğu mallarda bulunması gereken şartlardır. Malik belli şartlara haiz zekât malının asıl malikinin Allah Teâlâ olduğunu bilerek farz olan zekatını ayette belirlenen kimselere vererek sosyal sorumluluk iki yönlü gerçekleşecektir. Bu çalışmada, zekât mükellefi ve zekâtın sarf yerleri açısından zekât mallarında aranan şartlar çerçevesinde, sosyal sorumluluk boyutları irdelenmeye çalışılacaktır. Yöntem: Bu çalışmada karşılaştırma yöntemiyle Zekât Mallarında Aranan Şartlar Bağlamında Sosyal Sorumluluk incelenmiştir. Elde edilen verilerle zekât mallarında aranan şartlar bağlamında mezheplerin mali sosyal sorumluluğa imkân veren bakış açıları ortaya konmaya çalışılmıştır. Bulgular: Zekâtı mali bir ibadet olarak kabul eden mezhepler, zekâtı farklı farklı tarif etmişlerdir. Hanefiler zekâtın farzıyyeti için şahsın eda ehliyetine haiz olmasını şart koşarlarken, Şafiîler ve cumhur zekât malının nisaba ulaşmasını yeterli görmüşlerdir. İslam’da zekât, ehliyete haiz mükellefin veya nisaba ulaşmış maldan devlete ödenen ve devletinde topladığı mecburi bir vergidir. Tevbe suresi 2/60. Ayette geçen sarf yerleri açısından da sosyal yardımlaşma müessesesidir. Zekâtın böyle bir müessese olarak bilinmesini sağlayan şeyler ise, zekât malının taşıdığı bazı şartlardır. Zekât bütünlüğünü oluşturan bu şartlar mülkiyet, nemâ, nisab, yıl, borç ve havaic-i asliyyedir. Zekât malları nâmidir (artıcı ve gelişen). Mülkiyet ise mal üzerinde tasarruf yapacak şahsa aidiyetini bildirmektedir. Çünkü sahipsiz ve başkasının mülkiyetinde olan mal üzerinde bir başkası tasarrufa ehil değildir. Yıl, zekât verilecek malın artış için gerekli süreyi; nisab ise malın zekât verilebilecek miktarını belirtmektedir. Bu şartları kabul etmede mezhepler ihtilaflıdır. Zekât mallarında aranan bu şartlar, zekât mükellefini fakir düşürmemekte ve temel ihtiyaçlarının karşılanmasını sağlamaktadır. Aynı zamanda mükellefi yeniden üretmeye teşvik etmektedir. Mükellef bu yönlerden güvence altına alındığında topluma yönelik mali sosyal sorumlulukları da tekrar etmektedir. İşte bunları sağlayan ise zekât mallarında aranan şartlardır. Böylece bu şartlar sosyal sorumluluk açısından iki yönlü bir işlev yerine getirmektedirler. Sonuç: Zekât Kuran’da belirtilen belli kimselere temlik edilen mecburi mali sosyal sorumluluğa haiz bir mükellefiyettir. Zekât mallarında aranan şartların çerçevelediği sınırlar dahilinde bu sorumluluk yerine getirilmektedir.
Abstract
Subject and Purpose: Zakat is obligatory according to the Qur'an and Sunnah. According to Hanafis, zakat is pure worship, while according to other jurists, it is a property-related obligation. The goods for which zakat will be given are mentioned clearly and implicitly in the texts. Fuqaha determined the conditions that must be met in order for these goods to be subject to zakat as "ownership, nema, havâic-i asliyye, nisab, debt and year". Some of these terms are indirectly related to social responsibility, while others are directly related. This relationship is two-sided: The first one is aimed at encouraging production, that is, saving, and for the livelihood of the zakat payer. The second one concerns the places where zakat is spent, that is, the highest stratum of the society, as it is the addressee of infaq. Ownership refers to the bond between the property and the owner and the right to dispose of the property. Other conditions are the conditions that must be present in the goods on which the owner has the right of disposition. Social responsibility will be realized in two ways, by giving zakat, which is obligatory, to the people specified in the verse, knowing that the real owner of the zakat property that has certain conditions is Allah. In this study, it will be tried to examine the social responsibility dimensions within the framework of the conditions sought in zakat goods in terms of the zakat payer and the places where zakat is spent. Method: In this study, "Social Responsibility in The Conditions Requested in Zakat Goods" has been examined by comparison method. With the data obtained, it has been tried to reveal the perspectives of the sects that opportunity financial social responsibility in the context of the conditions sought in zakat goods. Results: The sects that accept zakat as financial worship have defined zakat in different ways. While the Hanafis stipulated that one must have the capacity to give zakat for fard zakat, the Shafiis and the people saw this as sufficient for the zakat goods to reach the nisab. In Islam, zakat is a compulsory tax paid to the state by the authorized taxpayer or the property that has reached the nisab and collected in the state. In Tevbe 2/60, it is also a social aid institution in terms of consumption places mentioned in the verse. The things that make zakat known as such an institution are some of the conditions that zakat property carries. These conditions constitute the integrity of zakat; property, nema, nisab, year, debt, and basic needs. Zakat goods are nami (increasing and growing). Ownership, on the other hand, declares that the property belongs to the person who will dispose of it. Because someone else is not authorized to dispose of property that is not owned and in the possession of someone else. The year is the time required for the property to be given zakat to increase; Nisab, on the other hand, indicates the number of goods that can be given zakat. The sects are disputed about accepting these conditions. These conditions sought in zakat goods do not make the zakat payer poor and ensure that their basic needs are met. It also encourages the taxpayer to reproduce. When the taxpayer is secured in these aspects, he repeats his financial and social responsibilities towards the society. What provides these are the conditions sought in zakat goods. Thus, these conditions fulfill a two-way function in terms of social responsibility. Conclusions: Zakat is an obligatory financial and social responsibility obligation given to certain people mentioned in the Qur'an. This responsibility is fulfilled within the limits framed by the conditions sought in zakat goods
