Özet

Yetim, öksüz, hasta, yaşlı, mecnun ve müsrif gibi ehliyetsiz kişiler, hayatlarını idame ettirebilmeleri, haklarından faydalanabilmeleri ve zor duruma düşmemeleri için hukukî ve malî temsile ihtiyaç duymaktadır. İslâm hukukunda himaye edilmesi zorunlu kılınan ve hakları üzerinde ehliyet sahibi olmayan bu kişilere genel olarak hacir denilmektedir. Kişiler, yaş ve sağlık durumları ile mali yetkinliklerine göre iki farklı şekilde hacir altına alınmaktadır. Buna rağmen hukukî ve malî temsil açısından eşit kabul edilen hacirlerin, yaş ve sağlık durumlarına göre şahsî bakım ve gözetime ihtiyaç duydukları aşikârdır. Çalışmamızın hazırlanmasında, Osmanlı döneminde vesâyet altındaki hacirler ile ilgili Konya Şer’iyye Sicilleri’ne yansıyan çeşitli tutanaklardan faydalanılmıştır. Öncelikle, 1640-1740 yılları arasına tarihlenen sicillerdeki örneklerden yetimler, öksüzler ve gözetime muhtaç olan diğer hacirlerin bakımı, muhafazası ve ihtiyaçlarının karşılanması hususunda nasıl bir yöntem izlendiği sorgulanmıştır. Ayrıca Osmanlı’da vasîlik kurumunun incelenmesi amacıyla; “Osmanlı vesâyet uygulaması, İslâm hukukundaki uygulamadan farklı mıdır? Bu dönemde hacirlerin korunması aileye mi, devlete mi aittir? Haciri koruyacak olan kişi veya kurumun hangi özelliklere sahip olması gerekir? Muhafaza ile görevli kişilerin yükümlülükleri nelerdir? Hangi şartlarda kişi, korunma altına alınır? Hacirin, bakım ve gözetimi süresince masrafları nasıl karşılanır?” gibi sorulara cevap aranacaktır. Bu soruların cevaplanması amacıyla fıkıh kitapları, fetvâ kitapları, ayet ve hadislerden istifade edilerek şer’iyye sicillerinde yer alan örneklerle uygulamanın ne olduğu, teorideki ve pratikteki durumunun nasıl olduğu tespit edilmeye çalışılmıştır.

Abstract

Noncompetent people such as orphan, motherless, mad, extravagantneed legal and financial representation to live on, benefit from their rights and not to get into a jam. These people, who should obligatorily be protected, and who are noncompotent fort heir rights are generally referred to as those with juridical disability. Persons are interdicted two different forms according to their age and health status and financial competence. Nevertheless, it is obvious that the juradical disability, which are considered equal in terms of legal and financial representation, need personal care and supervision according to their age and health status. During the preparation of our study, various official reports, reflecting on the Konya’s court records regarding people with juridical disability who were undercustody in Ottoman period, were used. Firstly, which method was followed regarding the care, maintenance and meeting needs of orphans, motherless people and other people with juridical disability who need supervision were questioned through samples from the records dating from 1640 to 1740. Moreover, the answer of question ssuch as “Is the application of wardship different from the practice in Islamic law? Is the protection of people with juridical disability under the responsibility of the state or family at this period? Which characteristics should the person or institution have that will protect person with juridical disability? What are the obligations of persons in charge of protection? Under which conditions is the person with juridical disability put under protection? How the expenses of person with juridical disability are covered during the period of care and supervision?” were sought with the aim of the investigation of wardship association in Ottoman. Benefiting from islamic law books, fetwa books, verses and hadiths, and also through the samples included in court records, the situation in theory and practice was attempted to be determined in order to answer above mentioned questions.
