Özet

Had, kısas ve ta’zir şeklinde tasnif edilen İslam ceza hukuku ilk ikisinin sınırlı olması ve cezalarının Şâri´ tarafından belirlenmesi sebebiyle füru fıkhın ukûbât konularının kâhir ekseriyetini oluştururken, ta’zir çoğunlukla had cezaları içerisinde bir “bâb” veya “fasıl” altında geçiştirilir. Kısas cezalarını bir tarafa bırakacak olursak fürû fıkıhta üzerinde en çok durulan ceza türü celde cezasıdır. Muhsan olmayanların zina etmesi durumunda yüz celde ve namusa iftira durumunda seksen celde ceza verilmesi Şari’in hükmüdür. İçki içene verilecek olan ceza da sahâbiler tarafından seksen celde olarak belirlenmiştir. Doktrinde ta’zir ile ilgili en önemli tartışmalardan birisi ta’zirin miktarı ile ilgili olanıdır. Ta’zir suçuna özgü belli bir ceza olmamasına rağmen tarihte en fazla uygulanan ta’zir ceza türü de celde cezasıdır. Dahası bazı ta’zir tanımlarının celde cezası esas alınarak tanımlandığı görülmektedir. Bu makalede ta´zir cezası olarak verilecek olan celdenin azamî ve asgarî miktarı hakkında mezheplerin görüşlerine yer verilecek, mezhep içerisindeki tartışmalara temas edilip her mezhebin ana görüşü ortaya konulacaktır.

Abstract

Islamic criminal law, classified as hadd, qisas and ta'zir, forms the vast majority of the İslamic legal science’s (fıqh) criminal law topics due to the fact that the first two are limited and their penalties are determined by Şâri’ (law maker). On the other hand ta'zir is often subsumed under a “bab” or “fasl” within hadd penalties. If we set aside qisas (retaliation) penalties, the type of punishment that is most focused on furû fiqh is jaldah (flogging) punishment. Shari's decision is to impose the punishment of a hundred jaldah in case of adultery of non-muhsan and punishment of eighty jaldah in case of qazf (slander of fornication). The penalty to be impozed to the drinker was also determined by the sahabis as eighty jaldah. In doctrine, one of the most important debates on ta'zir is about the amount of ta'zir. Although there is no specific punishment to the ta'zir crime, in history, the most common type of ta'zir punishment is jaldah punishment. Moreover, some definitions of ta'zir are defined on the basis of jaldah punishment. This article analyses different opinions of İslamic law schools in regards to maximum and minimum amount of jaldah to be impozed as ta’zir punishment and the discussions within the sect will be contacted and the main opinion of each sect will be revealed.
