Çocuk İstismarı ve Sosyal Devlet Kapsamında Çocuk İstismarına Yönelik Alınan Önlemler

Özet
Çocuk istismarı anne, baba, bakıcı veya herhangi bir yetişkin tarafından çocuğun fiziksel, duygusal ya da cinsel açıdan zarar görmesine neden olan bir sosyal sorundur. Ciddi sonuçlar yaratmadığı sürece üstü örtülmeye çalışılan çocuk istismarı ancak büyük sağlık sorunlarının meydana gelmesi ve mağdurun hastaneye başvurması sonucunda ortaya çıkabilmektedir. Çocuk istismarı, fiziksel ve cinsel istismarlar nedeniyle sosyal bir sorun olarak değerlendirilse de bu sorunun duygusal ve ekonomik istismar boyutlarında da sınıflandırması mümkündür. Bu sorunun altında yatan nedenler, kültürel olgular, gelenekler, anne babanın eğitim durumu, ailevi sorunlar, işsizlik vb. olarak belirlenebilir. İstismarı yaşayan çocuklarda güvensizlik, kendini değersiz görme, okul hayatındaki başarısızlıklar, yeni fobilerin oluşması, ortaya çıkan sorunlardan yalnızca birkaçıdır. Sosyal devlet anlayışı gereği bu sorunun çözümü ve önlenmesi için Türk hukuk düzeni içerisinde bir takım önlemler yer almakta ve sosyal hizmet anlamında çeşitli uygulamalar bulunmaktadır. Bu çalışmada çocuk istismarının tanınması ve önlenmesi amacıyla; Türk hukuk düzeni içerisinde yer alan ve sosyal hizmet bağlamında yapılan uygulamalara yer verilmiştir. Aynı zamanda çocuk istismarının çözümü ile ilgili denetim mekanizmasının arttırılması ve istismarın ortaya çıktığı andan itibaren çocuğun korunması amacıyla yasal uygulamaların titizlikle yerine getirilmesine yönelik çalışmaların yapılmasının gerekliliği de vurgulanmaktadır.
Abstract
Child abuse is a social problem in that the child is abused physically, emotionally or sexually by parents, carers or any adult. As long as there are no serious consequences, the child abuse is convered up and can be come up as a result of major health problems and with the victim’s referral to the hospital. Although child abuse is considered a social problem due to physical and sexual abuse, it is possible to classify this problem also in the dimensions of emotional and economic abuse. The underlying causes of this problem are cultural events, traditions, education of the parents, family problems, unemployment, etc..Insecurity, self-worthlessness, failures in school life, and the emergence of new phobia are just a few of the problems that arise in abused children. For the solution and prevention of this problem due to the understanding of the social state, there are a number of measures in the Turkish legal order and there are various applications in the sense of social service. In this study, for the purpose of recognition and prevention of child abuse; The application is made in the context of Turkish law and social services. At the same time, increase the control mechanism of child abuse resolution and the necessity of carrying out studies for the meticulous fulfillment of legal practices in order to protect the child from the time of the occurrence of the abuse is emphasized.
