Özet

Kamu idaresinde hizmete girecekler için bazı şartlar aranır. Genel ve özel şartlar olarak belirlenen bu şartlar; Türk vatandaşı olmak, yaş, öğrenim, askerlik, sağlık şartları ile kurumların mevzuatında belirtilmiş özel şartlar yanında kamu haklarından mahrum olmamak, kasten işlenen bir suçtan bir yılın üstünde hapis cezası almamış olmak ve kanunda tek tek sayılan suçlardan dolayı mahkûm olmamak şeklinde Devlet Memurları Kanunu’nda düzenlenmiştir. Devlet memuru olabilmek ve devlet memuru olarak kalabilmek için bu şartların taşınması gerekir. Bu şartları taşımayanlar hiçbir şekilde memur olamazlar. Devlet memurlarının memurlukları sırasında bu şartlardan herhangi birini kaybetmesi halinde ise memurluğu sona ermektedir.

Abstract

In order to be a civil servant within the Turkish public administration, there are a number of provisions. These qualifications, determined as general and specific, are arranged in the Code of Civil Servants. As well as specific provisions set out in the legislations of the institutions, there are other provisions like Turkish citizenship, age, education, military service, health conditions, not to be deprived of public rights, not to be sentenced imprisonment more than one year because of a crime committed on purpose and not be convicted for certain crimes stated in the Law. In order to be a civil servant or continue to be a civil servant, it is necessary to hold these qualifications. Those who do not carry the qualifications cannot be a civil servant under any circumstances. The status of being a civil servant terminates if one of these qualifications is lost.
